Transfer of undertakings - ADI (UK) Ltd v Firm Security Group Ltd - The Court of Appeal holds that employment tribunals must treat the employees of an existing contractor in a labour-intensive undertaking as transferred to a new contractor, if the reason or principal reason why the incoming contractor did not take the employees on is to avoid the application of the Transfer of Undertakings Regulations.
