This article presents the results of research that addresses the problem of interpretation and justification of the right to Sabbath of members of the Seventh-day Adventist church, from a subordinate theoretical framework approached by Ronald Dworkin. From a critical reading of Taking Rights Seriously and Law’s Empire the specific objetive that aims to identify the fundamental thesis of Dworkin that will surely provide a modern view to the question of Sabbath. When It involves conflicting legal interests. The resolution is proposer as follow: the idea of individual rights is analyzed, then the philosophical contribution reviewed Dworkin’s theory of “Hard Cases”. Finally, It shows You the importance of adopting the Dworkinian position against the moral and law relationship. ; Este artículo presenta el resultado de una investigación que aborda el problema de interpretación y justificación del derecho al Sabbath de los miembros de Comunidades Adventistas del Séptimo Día, desde un marco teórico subordinado a los planteamientos de Ronald Dworkin. Desde una lectura crítica de Taking Rights Seriously y Law’s Empire se desarrolla el objetivo específico que se propone identificar las tesis fundamentales de Dworkin que, seguramente, brindan un enfoque novedoso a la cuestión del Sabbath, cuando ésta supone intereses jurídicos contrapuestos.
