Coercive psychiatric care and detention offenders with mental disorders in Belgium

The author analyzes legal position of the offenders with mental disorders in Belgium. It shows the development of legislation, traditionally (since 1930) based on criminological social defence theory, problems which occurred in earlier laws and attempts to overcome these deficiencies. The paper analyzes: the legal nature of administrative measure detention of mentally ill offenders, conditions for pronounced measure and the method of enforcement.
