The aim of this publication is to bring closer legal regulations referring to issues of legalization and availability of soft drugs in Poland. Basing on regulations of the international law as well as on the most important acts of the intra-Community law fundamental reasons are indicated for which depenalization of behaviours such as the possession or production of the so-called soft drugs is not at present possible.
