Trade disputes and judicial pragmatism? - The Court of Appeal has in several recent cases considered various aspects of the law relating to industrial action, including questions of what wnounts to a legitimate "trade dispute" and the legality of industrial action ballots and notices. Our feature draws on these cases in order to analyse current judicial thinking in this area, and asks whether a purposive approach based upon pragmatism, rather than legalism, may be discerned.
