Statutory trade union recognition (2): Individual rights - The second in a trilogy of Guidance Notes focuses in particular on the right of individual "workers" not to be subjected to any detriment or (in the case of "employees" narrowly defined) dismissal on a number of grounds related to the new statutory union recognition procedure. This includes protection for workers who act, or propose to act, with a view to obtaining or preventing recognition thereunder, or who campaign or vote in recognition ballots. We also consider the extent to which workers in fact have any generally enforceable legal rights to time off (paid or unpaid) either during recognition ballots, or in the context of the operation of a bargaining method specified by the Central Arbitration Committee.
