The (re)definition of redundancy - The definition of ,,redundancy" for the purposes of the individual statutory rights to a redundancy payment and not to be unfairly dismissed has been construed and applied in variety of ways by the courts and tribunals over the years, with the various tests that they purportedly propounded creating apparently conflicting lines of authority. Recently, however, that definition has been comprehensively reconsidered by the EAT, the Court of Appeal and the House of Lords. Our feature reappraises the definition of redundancy in the light of those authorities and other recent case law on the subject.
